flowbear™ is a product and trade name of Flowbear Holdings LLC (“Company,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
1. About flowbear™
flowbear™ (“flowbear,” “we,” “us,” or “our”) provides a cloud-based software platform that enables businesses to manage customer communications, automations, workflows, and related operational tools.
flowbear™ is a software provider only and does not provide legal, marketing, or compliance advice.
2. Eligibility & Account Registration
You must be 18 years of age to use the Services. By creating an account, you represent that:
You have the authority to bind yourself or your business to these Terms
All information you provide is accurate and current
You will maintain the security of your login credentials
Process payments and manage business subscriptions
You are responsible for all activity that occurs under your account.
3. Use of the Services
You agree to use flowbear™ only for lawful purposes and in compliance with all applicable laws, regulations, and carrier policies.
You agree not to use the Services to:
Send unsolicited or non-consensual messages (“spam”)
Engage in fraudulent, deceptive, or abusive activity
Violate TCPA, CTIA, CAN-SPAM, or similar regulations
Transmit harmful, obscene, or illegal content
Infringe on the rights of others
Circumvent system limitations or security measures
We reserve the right to suspend or terminate accounts that violate these Terms.
4. SMS Messaging Responsibilities & Consent
SMS Carrier Disclaimer
Mobile carriers are not liable for delayed or undelivered messages.
Flowbear Holdings LLC provides a software platform that enables its customers to send SMS messages to their own contacts.
You acknowledge that you, as the customer using the Flowbear platform, are responsible for obtaining proper opt-in consent from your contacts before sending SMS messages.
SMS messages sent via the Flowbear platform on your behalf may include account notifications, verification codes, appointment reminders, support responses, and other transactional or informational messages.
Marketing SMS messages shall only be sent to recipients who have expressly opted in to receive promotional messages separate from transactional consent.
Message & data rates may apply. Recipients may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or contact the sending business directly.
Flowbear Holdings LLC does not sell or share mobile numbers or consent information for marketing purposes. SMS data may be shared only with messaging service providers necessary to deliver the messages.
5. Messaging & Communications Compliance
flowbear™ enables messaging via SMS, MMS, voice, email, and other channels.
You acknowledge and agree that:
You are solely responsible for obtaining proper consent from your contacts
You are the “sender” of messages initiated through your account
Message delivery is not guaranteed and is subject to carrier filtering and third-party platforms
flowbear™ is not responsible for message content, opt-in collection, or compliance failures
6. SMS Messaging & Terms of Use Cases
flowbear™ may send SMS messages to users who have provided prior express consent. SMS messages may include, but are not limited to:
Appointment confirmations and reminders
Automation audits or demos
Account or platform notifications
Customer support responses
Follow-ups related to requests or inquiries initiated by the user
SMS messages are only sent to users who opt in through a compliant web form or other lawful opt-in method. Message frequency varies based on user interaction and account activity.
7. SMS Opt-Out Instructions
You may opt out of receiving SMS messages from flowbear™ at any time by replying STOP to any message. After opting out, you will no longer receive SMS messages unless you re-subscribe.

8. Messaging & Data Rates
Message and data rates may apply depending on your mobile carrier and plan. flowbear™ is not responsible for any charges incurred from receiving or sending SMS messages.
9. Customer Data & Ownership
You retain ownership of all data you upload or generate using the Services (“Customer Data”).
By using flowbear™, you grant us a limited, non-exclusive license to process Customer Data solely for the purpose of providing the Services.
You are responsible for:
The legality of Customer Data
The accuracy of Customer Data
Ensuring you have the right to use and upload Customer Data
10. Third-Party Services
flowbear™ integrates with third-party providers (including messaging, hosting, analytics, and payment services).
We are not responsible for:
Third-party outages or service interruptions
Carrier filtering or blocking
Changes in third-party policies or pricing
Use of third-party services is subject to their respective terms.
11. Fees, Billing, and Payments
Certain features of flowbear™ require payment.
You agree to:
Pay all applicable fees as described at the time of purchase
Maintain valid payment information
Authorize recurring charges where applicable
All fees are non-refundable unless otherwise stated in writing.
We reserve the right to change pricing with reasonable notice.
12. Suspension & Termination
We may suspend or terminate your access to the Services at any time if:
You violate these Terms
Your use poses legal, financial, or reputational risk
Required by law, carriers, or platform partners
Upon termination:
Access to the Services will end

Reverse engineer or resell the Services
Use our branding without permission

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
flowbear™ does not guarantee uninterrupted service, error-free operation, or specific business outcomes.
15. Limitation of Liability
To the maximum extent permitted by law:
flowbear™ shall not be liable for indirect, incidental, or consequential damages
Our total liability shall not exceed the amount paid by you to flowbear™ in the prior 12 months
16. Indemnification
You agree to indemnify and hold harmless flowbear™ from any claims, damages, or expenses arising from:
Your use of the Services
Your messaging or communications
Your violation of laws or third-party rights
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
